PUMA FOOTBALL PROMOTION - Terms and Conditions

NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  By entering, entrants agree to be bound by the Terms and Conditions. By entering the Promotion, entrants are deemed to have accepted the Terms and Conditions and any other information regarding prizes and how to enter and any Promotion notices posted at http://puma.com/football (together the “Terms and Conditions”).  This document will have priority over any inconsistent terms in any applicable Promotion notice.

This Promotion is in no way sponsored, endorsed or administered by, or associated with Twitter.

1. PROMOTION PERIOD The Promotion will commence at 19:45 GMT on 08/03/2011 and close at 00:00on 10/03/2011 (“Promotion Period”).



2.1 Directors, management, officers and employees (and their immediate family (parents, children, siblings and spouses) and household members) of the Promoter, and their affiliated companies and advertising and promotional agencies, representatives and entities involved in the implementation and execution of the Promotion are not eligible to participate.



3.1 To enter the Promotion, you must do the following during the Promotion Period: (a) visit the PUMAFootball Twitter Page; (b) follow @PUMAFootball; and (c) reTweet a designated Tweet posted by PUMAFootball at around 19:45 on 09/03/2011.

3.2 Entry information, including answers to the Question are collectively referred to herein as "Entry" or "Entries".

3.3 Entrants who complete the steps in paragraph 3.1 will be entered into the Promotion.

3.4 Entry to the Promotion is restricted to entrants who participate via the PUMAFootball Twitter Page.

3.5 Entries must be received during the Promotion Period. All Entries become the property of the Promoter.

3.6 Odds of winning will depend upon the number of eligible entries received.

3.7 Only one Entry per person is permitted. The validity of any Entry is subject to verification by the Promoter.

3.8 Entries must also conform to the following additional requirements in the Promoter’s sole discretion:

a) Entries cannot be sexually explicit or suggestive, violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, contain nudity or any materially dangerous activity;

b) Entries cannot promote illegal drugs or firearms (or the use of any of the foregoing), or any activities that may appear unsafe or dangerous, or any particular political agenda or message;

c) Entries cannot be obscene or offensive, endorse any form of hate or hate group;

d) Entries cannot defame, misrepresent or contain disparaging remarks about the Promoter or their products or services, or other people, products or companies;

e) Entries cannot contain trademarks, logos owned by others (except trademarks and logos owned by PUMA), or advertise or promote any brand or product of any kind (other than those owned by PUMA), without written permission;

f) Entries cannot contain copyrighted materials owned by others without written permission;

g) Entries cannot contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, without written permission;

h) Entries cannot communicate messages or images inconsistent with the positive images and/or goodwill to which the Promoter wishes to associate; and

i) Entries cannot depict, and cannot itself, be in violation of any law.

3.9 Entries posted by entrants are the views and opinions of the individual entrants and do not reflect the views of the Promoter or its contractors and agents in any manner. By submitting an Entry, you agree that your submission is gratuitous and made without restriction, and will not place the Promoter under any obligation, and the Promoter is free to disclose the ideas contained in the Entry on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. You acknowledge that, by acceptance of your Entry, the Promoter does not waive any rights to use similar or related ideas previously known to the Promoter, or developed by its employees or contractors, or obtained from sources other than you. By entering, you acknowledge that the Promoter has no obligation to use or publicise any ideas in the Entry you submit. 3.10 By submitting an Entry you warrant and represent that it:

(a) is your original work;

(b) has not been previously published for commercial use or licensed for use by others;

(c) has not won previous awards;

(d) does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property, proprietary property or other rights of any person or entity;

(e) that you have obtained permission from persons whose name, likeness, or image is used in the Entry; and

(f) that publication of the Entry via various media including internet/online posting, will not infringe on the rights of any third party. Any such entrant will indemnify and hold harmless, the Promoter, its parent, subsidiary, affiliate and related companies and its contractors and agents, from any claims to the contrary.



4.1 After the Promotion Period has closed, the Promoter will select a shortlist of 100 random entries (assuming 100+ entries are made). These entries will be written on pieces of paper and selected at random by members of the public.

4.2 The selected 10 Winners will be announced on the PUMA Football Twitter Page within one week of the Promotion Period closing. To claim their Prize, Winners will need to contact the Promoter via direct message on Twitter and provide complete contact information (full name, email address and mailing address). The Prize will be forfeited if it is not claimed by the Winner within 14 days of the Winners’ names being announced.

4.3 For the purposes of this Promotion the “Prize” that each of the 10 Winners shall be entitled to receive, is a signed PUMA Tottenham shirt.

4.4 The Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to the Prizes.

4.5 Winners may be required to sign a standard Consent and Release form confirming compliance with the Promotion Terms and Conditions and releasing the Promoter and its directors, affiliates, representatives, advertising and promotional agencies from any and all liability arising from their participation in the Promotion or out of, pursuant to, or as a result of the carrying out of the Promotion, including liability arising from the acceptance of and usage of the Prize as awarded. Failure to comply with the Promotion Terms and Conditions or to sign and return the Consent and Release form within 5 of the date on the documents may result in disqualification and forfeiture of the Prize.



5.1 If a winning Entry is deemed not to comply with the Terms and Conditions, the Entry will be discarded and a new winner of that Prize will be determined by the Promoter selecting a further valid Entry.

5.2 The Promoter may require Winners to provide proof of identity, proof of residency and proof of age. Identification considered suitable for verification is at the Promoter’s discretion.

5.3 Limitation of Liability – General The Promoter, its parents, subsidiaries, affiliates and their associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

5.4 Limitation of Liability – Promotion Operation The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected Entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.

5.5 Disqualification The Promoter may, in its sole discretion, disqualify any Entries from, and prohibit further participation in this Promotion by, any person who tampers with or benefits from any tampering with the Entry process or with the operation of the Promotion or acts in violation of the Terms and Conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person. [Any attempt by any participant to obtain more than one (1) entry in the Promotion Period by using multiple or different identities, or any other prohibited methods will void that participant’s entry and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification.

5.6 Modification If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, subject to applicable laws and regulations, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion, or invalidate any affected Entries. In the event of such an occurrence the Promoter may post a notice atwww.puma.com/football. In the event of cancellation, the Promoter shall be entitled to award the Prizes from among all eligible, non-suspect Entries received prior to cancellation.

5.7 Acceptance and Substitution of Prizes The Prizes are not transferable, exchangeable nor redeemable for cash. The Promoter accepts no responsibility for any variation in Prize value. If a Prize is unavailable for any reason, the Promoter may substitute for that Prize another item of equal or higher value as determined by the Promoter, subject to the approval of the relevant authorities in each state and territory if required.

5.8 Taxes The Promoter is not liable for any tax implications arising from the Prize or Promotion. The Winner will be solely responsible for any and all applicable taxes and any other costs, expenses and fees, in connection with their participation in the Promotion and acceptance of any prize.

5.9 Publicity By entering the Promotion, you grant permission for the Promoter and its designees to use your name, address (town/city and county), photograph, voice and/or other likeness for advertising, trade and promotional purposes in any and all media now known or hereafter discovered, worldwide, in perpetuity, without compensation, notification or permission. You hereby waive any and all claims to any moral rights you may have in connection with your Entry into the Promotion in every territory of the world to the full extent same may be waived.

5.10 Personal Information By participating in the Promotion, you consent to the collection, use and disclosure of your personal information for the purposes of this Promotion and delivery of any Prize. The Promoter may disclose your personal information to its related and affiliated companies, contractors and agents to assist in conducting the Promotion or communicating with you. If you have so elected, you consent to the storage of your personal information on the Promoter’s database and the Promoter may use this information for future promotion and marketing purposes regarding its products, services or rewards, including contacting you via electronic messaging. The collection, use and disclosure of any personal information you provide is subject to the Promoter’s Privacy Policy which is set out on puma.com/football.

5.12 Winners’ Names The names of the Winners will be available approximately three (3) weeks after the close of the Promotion Period and can be obtained from the Promoter’s aid, Spook Media 105 Victoria Street, London, SW1E 6QT. They will be available until 30st April 2011.

5.13 Governing Law The terms and conditions of this Promotion shall be governed by and construed in accordance with the laws of England & Wales without regard to the conflict of laws provisions. You agree to submit to the exclusive jurisdiction of the courts located in England & Wales.
